This agreement establishes the terms governing your use of the “Orbelian” platform, encompassing material and information usage, your rights, and the functionality enabling donation receipt, donation creation, account creation, project initiation, and similar features on the site.

Upon acceptance of this Agreement’s terms, you pledge to adhere to the stipulated terms and conditions herein. By making a payment, you acknowledge and confirm that you are of legal age and are entering into a contract with “Orbelian”. If you are representing an organization when applying or donating, you warrant that you possess due authorization to act on behalf of said company/organization.

“Orbeliani” retains the prerogative to modify this agreement periodically, disseminating updates exclusively on this platform. Additionally, “Orbelian” holds the right to effect changes to the site without the obligation to retain content submitted by you, without prior notice.

The collection and utilization of personal information are governed by our personal information policy.

You consent and acknowledge:

• The provision of accurate information to us.
• Your entitlement to share said information.
• Your responsibility for safeguarding your profile.
• The possibility of third-party use of information you publish without “Orbelian” consent.

Rules of Conduct on the Site:

You commit not to post or distribute:

1.1. Content containing hate speech, derogatory or threatening material, false or deceptive information.

1.2. Any content not protected by patent, copyright, or proprietary rights without requisite permissions.

1.3. Material that promotes terrorist or criminal activities or advocates violence.

Termination of the Agreement:

2.1. The agreement remains valid until its termination.

2.2. “Orbelian” retains the right to restrict your access to the Service upon violation of this Agreement. Advanced notification of this action is not obligatory.

For Donors:

3.1. Payment terms are outlined on the website. Payment can be made via card or direct transfer to the “Orbeliani” account, with project identification during the transfer process.

3.2. We strive for accuracy in providing information about idea authors, project goals, and progress, conducting validation of project authors before publication. The project’s target amount may also be adjusted due to fluctuations in the GEL exchange rate or at the project author’s request.

3.3. Sole utilization of your personal card or financial account for payment is required.

3.4. Donations made are non-refundable.

3.5. In cases where the author of a target project declines the funds, “Orbeliani” retains the right to redirect the donation to another project with similar content/purpose, upon mutual agreement.

Utilization of Shared Information:

4.1. The use of personal information is regulated by our privacy policy. Accepting the Service’s terms also implies agreement to this document’s terms.

4.2. Content uploaded to your page must be original and non-infringing on copyrights.

4.3. “Orbelian” reserves the right to rectify or remove content that violates copyright or contains threats or calls for violence.

4.4. “Orbelian” may employ uploaded content for promoting projects and the platform.

Security:

5.1. You bear personal responsibility for safeguarding your account, email, and password data, refraining from sharing it with any third party.

5.2. Site security is reinforced by antivirus programs and encryption technology. However, it’s important to note that, like any website, the “Orbeliani” platform is not immune to hacking attempts.

5.3. TBC Bank assumes responsibility for card and financial transaction security; “Orbelian” lacks access to your card data.

General Provisions:

7.1. “Orbeliani” reserves the right to modify the site’s terms of use and will publish the updated version exclusively in electronic format on the same site.

7.2. “Orbeliani” does not guarantee a gift to donors in return for their donations. The responsibility for providing and delivering the gift rests entirely with the idea’s author. Gift delivery terms are to be mutually agreed upon between the donor and the idea’s author.

7.3. “Orbeliani” commits to overseeing the execution of funded projects and will provide the financial statement document for the target project to the donor upon request.

7.4. “Orbeliani” is responsible for project validity verification and retains the right to request supplementary information before publishing an idea if deemed necessary.
